In consideration and for the privilege of participating in all activities at Joseon Martial Arts Visitor or Trial student, Student, Parent, Guardian, Guarantor, Payer or Family Member or Friend, and in further consideration of being accepted to participate with/in the Joseon Martial Arts Academy and its programs, I do hereby acknowledge that my participating in the gym, I and or my child (ren) may suffer bodily injury or death, illness, COVID19 or its variants, and loss of property, and I do hereby for myself, for my heir, parents, guardians, executors, personal representatives and assigns, release, acquit, waive, forever discharge, hold harmless, and agree to indemnify Choson Martial Arts Academy Inc., The Martial Arts Commission of Utah, Joseon Health and Wellness, The Utah Military Academy,  all the sponsors of this company and any other persons, including its instructors and officers or organizations connected with the same of and from any and all liability, claims, demands, costs, damages, actions, causes of actions, or suits of any nature or kind whatsoever that I, my heirs, parents, guardians, executors, personal representative, assigns or administrators may now or hereafter have or claim to have, on account of or arising out of personal injuries, death, or damage to my person or property or loss of time, loss or service, or for expense incurred, occurring to me because of or in any way related to my participation, training for, my traveling to, my participating in gym activities, including but not limited to transportation to/from gym activities, and my returning from said activity or through the use of any and all facilities connected therewith: provided that this waiver of liability does not apply to any acts of gross negligence, or intentional, or willful or wanton misconduct. It is further understood this waiver, release and indemnification agreement binds all Joseon Martial Arts Students, Parents, Guardians, Guarantors, Payer or Family Members or Friends, should any legal action arise from a spouse or other family member, friend, referral, or any person connected with the signer of this waiver, the signer does agree to indemnify Joseon Health and Wellness, DBA: Joseon Martial Arts and Utah Military Academy and its staff, instructors, and officers under the indemnity terms listed herein.
